Terms and Conditions

§1: General Provisions

Orders from private and commercial customers of sport-tiedje GmbH are subject to these terms and conditions. Contracting party is the Sport-Tiedje GmbH, Heinrich-Hertz-Straße 13-15, D-24837 Schleswig, in the following referred to as Sport-Tiedje. Conflicting conditions of the customer or conditions differing from those indicated in our terms and conditions are not valid for us. This applies even if we carry out deliveries without reservation in full knowledge of conflicting conditions of the customer.

§2: Prices, Payment

All quoted prices include the value added tax prescribed by law. All quoted prices are subject to change without notice. As far as technically possible, payment can be made by cash on delivery (COD), automatic debit transfer, credit card or cash in advance. Payment by automatic debit transfer is possible only from German bank accounts.
Germany: Exclusively the prices of the German online shop under www.sport-tiedje.de are relevant to orders with delivery within Germany and sales on location at a German branch. The quoted prices include 7% value added tax for books and food and 19% for all other items.
Austria: Exclusively the prices of the Austrian online shop under www.sport-tiedje.at are relevant to orders with delivery within Austria and sales on location at an Austrian branch. The quoted prices include 10% value added tax for books and food and 20% for all other items.
Switzerland: Exclusively the prices of the Swiss online shop under www.sport-tiedje.ch are relevant to orders with delivery within Switzerland and sales on location at a Swiss branch. The quoted prices include 2,4% value added tax for books and food and 7,6% for all other items. All costs for customs clearance as well as the actual customs duty are already included in the price.
Payment by cash on delivery is not possible when delivery is made by the DPD.
Denmark: Exclusively the prices of the Danish online shop under www.sport-tiedje.dk are relevant to orders with delivery within Denmark and sales on location at an Danish branch. The quoted prices include 25% value added tax.
Payment by cash on delivery is not possible when delivery is made by the DPD.
Sweden: Exclusively the prices of the Swedish online shop under www.sport-tiedje.se are relevant to orders with delivery within Sweden. The quoted prices include 6% value added tax for books, 12% value added tax for food and 25% for all other items.
Payment by cash on delivery is not possible when delivery is made by the DPD.
France: On orders for delivery within France, exclusively those prices are valid that are listed in the French online shop, www.sport-tiedje.fr. The prices indicated include 19,6% value added tax or 5,5% VAT for books and food items.
Payment by cash on delivery is not possible when delivery is made by the DPD.
Great Britain: On orders for delivery within Great Britain, exclusively those prices are valid that are listed in the British online shop, www.sport-tiedje.co.uk. The prices indicated include 19% VAT, or 7% VAT for books and food items.
COD payment is not possible with deliveries by DPD.
Netherlands: For orders with delivery within the Netherlands, only the prices in the dutch onlineshop www.sport-tiedje.nl are applicable. The quoted prices include 6% VAT for books and food and 19% VAT for all other products. Payment by cash on delivery is not possible for orders shipped by mail or DPD parcel service.
Belgium: For orders with delivery within Belgium, only the prices in the belgium onlineshop www.sport-tiedje.be are applicable. The quoted prices include 6% VAT for books and food and 21% VAT for all other products. Payment by cash on delivery is not possible for orders shipped by DPD parcel service.

§3: Delivery

Delivery of items with up to 31kg of weight is made by the Deutsche Post or the DPD, larger and bulkier orders are sent by a carrier with a notification of dispatch by phone. The parcel services deliver beyond the doorstep of the apartment, the carrier delivers only beyond the first lockable ground-level door (e.g. not to the cellar, to the attic or other rooms). As a rule, Sport-Tiedje buys transport insurance with no additional cost for you.
There might be an additional surcharge for deliveries on to Islands; the customer will be notified individually.
Costs for shipping and handling and incidental COD charges are disclosed within the scope of the order acknowledgement. No hidden costs are incurred.
Germany: Delivery within Germany by the Deutsche Post and DPD is free of charge for all items except weight plates and free weight bars when order values exceed EUR 45.00. Deliveries by carrier that do not contain free weight bars or plates are free, when order values exceed EUR 100.00. Weight plates and free weight bars are also delivered for free in combination with exercise equipment and order values exceeding EUR 100.00! With all other deliveries you incur only a fraction of the shipping costs, and when paying by cash on delivery there is an additional COD charge.
Austria: Delivery within Austria by the Deutsche Post and DPD is free of charge for all items except weight plates and free weight bars when order values exceed EUR 60.00. Deliveries by carrier that do not contain free weight bars or plates are free, when order values exceed EUR 500.00. With all other deliveries you incur only a fraction of the shipping costs, and when paying by cash on delivery there is an additional COD charge.
The Austrian postal service charges a delivery fee for COD deliveries, independent of order value, that is due when delivery is made and over which Sport-Tiedje has no influence.
Switzerland: Delivery within Switzerland by the Deutsche Post and DPD is free of charge for all items except weight plates and free weight bars when order values exceed CHF 150.00. Deliveries by carrier that do not contain free weight bars or plates are free, when order values exceed CHF 500.00. With all other deliveries you incur only a fraction of the shipping costs, and when paying by cash on delivery there is an additional COD charge.
The Swiss postal service charges a delivery fee for COD deliveries, independent of order value, that is due when delivery is made and over which Sport-Tiedje has no influence.
Denmark: Delivery within Denmark by the Deutsche Post and DPD is free of charge for all items except weight plates and free weight bars when order values exceed DKK 550.00. Deliveries by carrier that do not contain free weight bars or plates are free, when order values exceed DKK 3000.00. With all other deliveries you incur only a fraction of the shipping costs, and when paying by cash on delivery there is an additional COD charge.
The Danish postal service charges a delivery fee for COD deliveries, independent of order value, that is due when delivery is made and over which Sport-Tiedje has no influence.
Sweden: Delivery within Sweden by the Deutsche Post and DPD is free of charge for all items except weight plates and free weight bars when order values exceed 1000 SEK. Deliveries by carrier that do not contain free weight bars or plates are free, when order values exceed 9000 SEK. With all other deliveries you incur only a fraction of the shipping costs, and when paying by cash on delivery there is an additional COD charge.
The Swedish postal service charges a delivery fee for COD deliveries, independent of order value, that is due when delivery is made and over which Sport-Tiedje has no influence.
France: Parcel delivery throughout France by the DPD or Deutsche Post is free for all purchases totaling at least EUR 75.00, except in the instance of free weight plates and bars. Delivery by freight carrier is free for all purchases of at least EUR 750.00, except in the instance of free weight plates and bars. For all deliveries you pay only a fraction of the total shipping charges, including an additional charge in the instance of COD delivery.
Great Britain: Parcel delivery throughout England by the DPD or Deutsche Post is free for all purchases totaling at least GBP 70, except in the instance of free weight plates and bars. Delivery by freight carrier is free on purchases totaling at least GBP 700, if the order does not include free weight plates or bars.
Freight delivery to Northern Ireland is free on purchase of at least GBP 100 (Post/DPD) or GBP 800 (freight carrier). For all other deliveries you pay only a portion of the total shipping costs, including an additional charge in the instance of COD delivery.
Netherlands: Shipping by mail or DPD parcel service is free of charge for order values greater than 75 Euros, except for weight plates and barbells. Orders that do not contain weight plates or barbells, but are shipped by a freight carrier are delivered free of charge when the order value exceeds 500 Euros. For all other deliveries, we only charge a part of the incurred shipping charges to the customer.
Belgium: Shipping by mail or DPD parcel service is free of charge for order values greater than 75 Euros, except for weight plates and barbells. Orders that do not contain weight plates or barbells, but are shipped by a freight carrier are delivered free of charge when the order value exceeds 500 Euros. For all other deliveries, we only charge a part of the incurred shipping charges to the customer.
other countries: For deliveries to countries, not explicitly listed above, we will gladly make you an individual offer. Please contact us by telephone or per email.

§4: Offers

All offers are subject to change without notice since delivery bottlenecks on part of the manufacturer can not always be ruled out. You can always inquire into delivery times through our telephone hotlines, we have most items on stock and therefore are able to deliver very quickly!

According to the distant selling law (Fernabsatzgesetz), you the consumer have the right to withdraw your order within 14 days of receipt of the goods. This right of withdrawal is ineffective for sealed goods that can be copied, if the packaging is opened or damaged, e.g. CDs, DVDs, videos, software and books, as well as for foods. In addition, orders from commercial customers and orders from non-european foreign countries are excluded from the right of withdrawal under the distant selling law.
The withdrawal does not require any justification and has to be declared in writing (by mail or fax) or by return of the unused and packaged goods.
To comply with this term, it is sufficient to dispatch the withdrawal or the goods in time to:

After Sport-Tiedje receives the goods and after consultation, the customer will receive a different item, or we will refund the purchase price, if already paid, to the customer. The charges of the return shall be in the responsibility of the customer if the returned goods cost less than EUR 40.00. The charges for return for orders exceeding EUR 40.00 shall be in the responsibility of Sport-Tiedje.

If you want to return something, please let us know beforehand by phone or by email. Please stamp smaller packages as a standard parcel. In that case, we will refund the shipping charges afterwards. If you choose a more expensive form of delivery or an unfranked return shipment, we only refund the shipping costs for the amount of such a standard parcel. In case of larger or bulkier orders, a carrier is assigned to pick up the goods after receipt of a withdrawal.

In case of a valid withdrawal, goods, services and payments received on either side shall be returned. If used goods are returned, Sport-Tiedje reserves the right to demand compensation for the time of use of such goods. In case of deterioration in the quality of the goods, compensation can also be demanded. No claims shall be admissible if loss of value should exclusively derive from testing.

§6: Warranty, Guarantee

The statutory warranty period of two years for defects attributable to material or manufacturing defects is valid unless otherwise stipulated by the manufacturer. This warranty is valid as long as the equipment is used appropriately and only for the intended range of uses and purposes.
Unless stated otherwise, all specified warranty periods are valid for home use, i.e. the unit is at home and exclusively for privat use. Light commercial and semi-professional use is understood as usage of no more than three hours a day under constant supervision. There is no entitlement to a warranty for intensive or unsupervised use unless professional studio use is warranted explicitly.
In case of defects, Sport-Tiedje reserves the right to a one-time rectification.
Even after the official warranty expires, Sport-Tiedje will supply you with spare parts at cost price as long as they are available.
Transport damages have to be reported to the carrier when goods are delivered. Hidden transport damages have to be reported in writing to Sport-Tiedje within 5 working days.

§7: Changes

Technical changes, especially improvements in design or consruction are reserved. These changes always serve further progress.

§8: Partial Nullity

Should individual provisions of the contract for delivery or of these terms and conditions become partially or completely invalid, this shall not affect the validity of the remaining provisions. The contracting parties shall replace the invalid provisions with valid provisions that come closest to both parties’ intended purposes.

§9: Applicable Law and Retention of Title

German law, under exclusion from CISG, is applicable to completed contracts with the Sport-Tiedje GmbH.
The delivered goods remain the property of the Sport-Tiedje GmbH until all receivables are completely paid.
